1. Agreement to these Terms

These Terms of Service ("Terms") govern your access to and use of the Joe Loves Ventura County website at joeknowsventura.com and related Logo Wall services (the "Site"). By using the Site or submitting a claim form, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.

2. The Logo Wall service

The Logo Wall is a promotional showcase of local brands. Submitting a claim request does not guarantee placement, pricing, timing, or any specific outcome. We may accept, decline, delay, remove, or rearrange logos at our sole discretion. Any fees, if applicable, will be communicated separately before payment is collected.

3. Claim requests & your responsibilities

When you submit a claim, you represent that:

• The information you provide (name, email, phone, and any brand details) is accurate and belongs to you or an organization you are authorized to represent.
• You have the right to use any logo or brand assets you later provide for display on the Site.
• You will not submit unlawful, misleading, infringing, or abusive content.

You grant Joe Loves Ventura a non-exclusive, royalty-free license to display logos and brand marks you supply on the Site and in related promotional materials for the Logo Wall program.

4. Communications consent (phone, SMS & email)

By providing your phone number and submitting a claim (or other contact form) on the Site, you agree that Joe Loves Ventura and our service providers may contact you at that number and email address regarding your request and related offerings. This may include phone calls, SMS/text messages, and emails for customer care, transactional updates, and marketing where you have consented and applicable law allows.

Message frequency varies. Message and data rates may apply. Consent is not a condition of purchase. Reply STOP to opt out of SMS; reply HELP for help. See our Privacy Policy for details on how we handle phone numbers and messaging data, including use of platforms such as GoHighLevel.

5. Acceptable use

You agree not to:

• Interfere with or disrupt the Site, or attempt unauthorized access to our systems.
• Use the Site to spam, harass, or send unlawful communications.
• Scrape, copy, or misuse Site content except as allowed by law or with our prior written permission.

6. Intellectual property

The Site design, Joe Loves Ventura branding, and original content are owned by us or our licensors. Third-party logos appearing on the wall remain the property of their respective owners and are used for identification / promotional placement purposes.

7. Disclaimers

THE SITE AND LOGO WALL ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation, or that claim submissions will result in placement.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOE LOVES VENTURA AND ITS AFFILIATES, OFFICERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR THESE TERMS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS (US $100) OR THE AMOUNT YOU PAID US (IF ANY) FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS BEFORE THE CLAIM.

9. Indemnity

You agree to indemnify and hold harmless Joe Loves Ventura from claims arising out of your use of the Site, your claim submissions, or your logos/brand assets (including infringement claims), except to the extent caused by our willful misconduct.

10. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Courts located in Ventura County, California, will have exclusive jurisdiction over disputes arising from these Terms, except where prohibited by law.

11. Changes

We may update these Terms from time to time. The "Last updated" date will change when we do. Continued use of the Site after updates constitutes acceptance of the revised Terms.
